These terms and conditions outline the rules and regulations for the use of My Keto World Ltd.

This website is operated by My Keto World. Throughout the site, the terms “we”, “us” and “our” refer to My Keto World. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall My Keto World, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless My Keto World and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.

SECTION 19 - RETURN

To be eligible for a return your item must be unused, in the same condition that you received and in its original packaging.If you are approved, then your refund will be processed, and a credit will automatically be applied to your original method of payment, within a reasonable amount of time

All sugar free bakery items are exempt from being returned. Please view the bakery return policy for more information.

SECTION 20 - ​FOOD ALLERGY DISCLAIMER

We cannot guarantee that our products are free from ingredients that may affect those with food allergies (they might still contain traces). If you have any serious allergies please contact us at myektoworldofficial@gmail.com before you place an order to inform us of any food allergies that you may have, we reserve the right to decline any orders for clients with serious food allergies. We take every precaution to avoid cross contamination but please note all our products are manufactured in an environment that handles Nuts, Tree Nuts, Peanuts, Seeds, Sesame, Celery, Soy, Gluten, Dairy, Eggs, Lupin, Mustard and Fish.

Please note that our products contain Xylitol, a sugar alcohol that is not suitable for dogs and other pets. Please do not share our products with a pet or leave the product unattended around pets. 

Please note that excessive consumption of erythritol, xylitol or high fibre products such as psyllium husk or linseeds may have a laxative effect. Consume high fibre products with plenty of liquid.

SUGAR FREE BAKERY

SECTION 21 - PRODUCTS

We offer a selection of no added sugar, low carb and keto friendly baked goods. Although all images are our own they are only used indicative, the actual size and product may vary. All our products are made by hand and accordingly there will be minor variations in appearance. All goods are made to order, that’s why processing can take  longer. All nutritional information is calculated by us and is only an estimate. The nutritional information is subject to change as we use natural ingredients and wholefoods. Please note that some food colourings used in our sugar free sprinkles may have an effect on behaviour in children.

SECTION 22 - STORAGE

Our products must be refrigerated or stored airtight straight upon receipt and according to the provided storage instructions in the product description . Our products must be consumed according to the provided description. Some items are suitable for freezing for up to two month, either well wrapped or in airtight containers or freezer bags. Defrost safely in the fridge and consume within 24 of defrosting.

SECTION 23- PURCHASE OF PRODUCT

Our website service permits you to purchase our Products from this Site. These purchases can be made and are permitted strictly pursuant to the terms and conditions on our website. We accept all major credit or debit cards as well as amazon pay.

SECTION 24 - CHANGES TO YOUR ORDER

It is ok to change your mind. We understand that situations can occur which can result in you wanting to change your order or add more items to your order. Please contact us as soon as possible within 48h from placing your order, to ensure any changes can be applied. We can not guarantee that it will be possible, but we will try our best to help you.

SECTION 25 - CANCELLATION POLICY

Cancellation can be made within 24h from placing an order. We will not accept any cancellation after 24h because after this time we start processing your order. All goods are individually made to order so if your item has already been baked, we are not able to offer it to someone else or re-sell it.

SECTION 26 - UNFORESEEN CIRCUMSTANCES

Where we cancel an order due to illness or unforeseen circumstances we will issue a refund within 7 working days of notification of the customer or we can rearrange the order if the customer wishes to do so.

.SECTION 27 - PROCESSING AN ORDER

Processing your order starts 24h after placing an order. Processing can take up to 7 working days. We reserve the right to change the processing time depending on the volume of orders and during busy periods like Christmas. We will inform you about any delays on our website and be in contact with you via email or phone. Please let us know if you need an order for a specific day and we will try our best to help you. Once your order is ready you will receive an email confirming pick up or delivery dates.

SECTION 28 - DELIVERY AND COLLECTION

We may be able to arrange a delivery for you within a 5 miles radius of our postcode EH2 3JG for a fixed £10 delivery fee, applied at the checkout. Please contact us via email if you have any questions or want to arrange an order with delivery.

A delivery date and time will be agreed by both parties. Please note that it is important to be available for delivery as your goods are perishable. Please ensure that someone is there to sign for your order. If the customer is not at the location at the time and date agreed and we are not able to contact the customer the product will be transported back to our premises. We cannot offer refunds or replacements in the case that you fail to accept your delivery.  

Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the products in appropriate condition, it is then up to the customer to store and care for the cake as per our directions on the website. If anything is to happen to the cake after exchange, we are not liable for any damage.

Collection of orders from our collection points are free and by appointment only.

It is the responsibility of the customer to check the state of the product before leaving the premises. Once the item has left the premises the customer is responsible to ensure that the products get to their destination safely and are stored as per our directions to achieve best results for taste and quality.

The customer is liable for any damage, accident or mishap that may occur once the products(s) are released from the supplier. The supplier is not liable for any damage that may occur thereafter.

If a third party is collecting the product on the customers behalf, a release form is to be signed by that person, stating the product is received in good condition at the time of pick up/delivery.

SECTION 29 - REFUND POLICY

Refunds may occasionally be offered. Refunds are only taken into consideration in circumstances where there is a clear reason to do so, for example, delivered products were mouldy, not safe to eat, or situations where you clearly did not receive what you have ordered. All claims for refunds will only be entertained if received in writing with pictures inculded, within 12 hours of collection or delivery. We will investigate the situation and make a decision as to whether we think a refund is suited.

Cancellation of an order is possible within 24h from placing an order and a full refund will be issued. We don’t offer refunds for changing your mind after 24h from placing an order.

 All our products are packed with extra care, however we can’t guarantee that they will arrive in immaculate condition if you choose the delivery option. Therefore we can not offer a refund if there was any damage to your order from delivery. 

We cannot offer refunds or replacements in the case that you fail to collect/receive your order on time of first delivery attempt or arranged collection day as all items are perishable. 

Taste is subjective and a matter of personal preference, therefore we cannot issue refunds for complaints raised merely because you do not like the taste of the products you received .

SECTION 30  - RETURN 

As all items are perishable we don’t accept returns.
